Seattle Atheists on the Supreme Court

The overturn of Roe v. Wade by the Supreme Court should come as a shock to no one. The movement to end women’s right to reproductive freedom has been a long time coming. All of the justices who voted in favor of Dobbs are deeply religious. This sad fact doesn't make the blow any less difficult to face. The Alito court is hiding behind what they term an “originalist” interpretation of the Constitution, while at the same time ignoring that this nation was founded with a clear intent to preserve human rights from theocratic menace.

They circumvent culpability for their personal religious views by offering the “Rational Basis Test,” which is a wholly contrived instrument of the court. The tortured reasoning behind RBT is that “true ends are irrelevant” and that any contrivance of imagination is enough to allow a law to stand. Under RBT, favored laws can be justified even by a thought experiment, allowing post hoc forgiveness for unintended consequences. It is, essentially an abdication of judicial power to review, and a smirking deference to “state’s rights.”

Writing against the Casey court, Alito denies the right to abortion can be included in the First, Fourth, Fifth, Ninth or Fourteen Amendments. In his opinion, neither privacy nor liberty includes bodily autonomy as a fundamental human right.

Slaves are forced to provide the labor of their bodies without choice or compensation; but, the biological consequences of conception, gestation, and birthing impact a body for a lifetime. More than turning women into slaves, the Supreme Court’s decision turns them into livestock. The reduction of human beings to incubators decries the Enlightenment values, upon which our country and its Constitution were founded: reason, liberty, tolerance, progress, and the separation of church and state.

Further, those who so fervently advocated for the overturning of Roe v. Wade have no real interest in caring for babies. If they did, maternal healthcare, free Pre-K, and access to contraception would have been part of their agenda. No, this decision is about controlling women and punishing sexuality. Justice Thomas has already stated that contraception and marriage equality are next on the chopping block. This decision unmasks the Supreme Court as an illegitimate, ideological cabal, seated to force Christian nationalist theocracy on us all. We believe that there is no freedom of religion without freedom from religion.
